User Agreement

(under the terms of a public offer)

This public offer agreement is between the Seller on the one hand and the Buyer, any person who has accepted the offer, on the other. This agreement is addressed to an unspecified number of persons. This Public Offer is valid until the adoption of a new version of the offer.

1. Terms and definitions
In this sentence, unless the context otherwise requires, the following terms have the following meanings and are an integral part thereof:

The buyer is any individual or legal entity, a visitor to the site, who places an order on the site https://lipunova.com for the purpose of purchasing goods and thereby confirms his/her agreement with all the terms and conditions of this offer.
Online store - the official online store of the Seller LIPUNOVA, located at the Internet address https://lipunova.com.
Under this agreement, the terms Online Store and Store, as well as the Internet address https://lipunova.com and all derivatives of lipunova are equivalent and are interpreted reliably, in accordance with the context of the offer.
Goods - the object of the agreement between the parties; clothing, accessories and other items presented in the official online store for the purpose of their sale.
Sales rules - Rules for selling goods in the LIPUNOVA online store. .
A promotional discount is a discount that is provided on a specific Product. The amount of the discount is indicated on the product page. The price of the product is already indicated taking into account the promotional discount.
A Coupon (Promo Code) is a special code that activates a special discount on a Product.

2. General provisions

2.2 By ordering the Product in the Online Store, the User agrees to the terms of sale of the Product posted on the website. If you do not agree to the terms of sale, the User must immediately stop using the service and leave the website https://lipunova.com
2.3 The current terms and conditions of sale of goods and information about goods posted on the website are public information in accordance with Article 633 of the Civil Code of Ukraine.
2.4 The current terms and conditions may be changed by the Seller without unilateral notice to the user/Buyer. The new version of the terms and conditions of this agreement shall enter into force from the moment of its publication on the website, unless otherwise provided for in the Agreement itself.
2.5 The Agreement comes into force from the moment the Seller confirms in any form to the Buyer the acceptance of the Order at the time of the Buyer's order on the Site, and from the moment the Order is accepted from the Buyer by the telephone number indicated on the Site.
2.6 By informing the Seller of his/her telephone number and e-mail, the Buyer consents to the use of these means of communication by the Seller, as well as by third parties involved in the fulfillment of its obligations to the Buyer.
The data may be used to disseminate information about the transfer of the order for delivery, as well as other information directly related to the fulfillment of the obligation to the Buyer under this Public Offer.
Also, the data provided by the Buyer may be used to distribute promotions, news about promotions, discounts and other actions of the Seller.
When fulfilling the Order, the User/Buyer agrees that the Seller may entrust the performance of the Agreement to third parties, remaining responsible for its performance.

3. Subject of the contract
3.1 The subject of this Agreement is the opportunity for the User to purchase for personal purposes, not related to the conduct of business activities, the Goods presented in the catalog of the online store https://lipunova.com

4. Product and purchase procedure
4.1 The Seller guarantees that the goods presented in the online store are available. The descriptions and characteristics accompanying the Product are not exhaustive and may contain typographical errors. In order to clarify information about the item of interest, the Buyer may contact the Support Service at any time by phone number specified in the online store.
4.2 In the absence of the Goods ordered by the Buyer, the Seller has the right to exclude the goods from the Order or cancel the Order by notifying the Buyer by e-mail or by contacting the Buyer by phone.
4.3 The Buyer bears full responsibility for providing inaccurate data that made it impossible for the Seller to fulfill its obligations to the Buyer.
4.4 In the event of a full or partial unavailability of a prepaid order, the buyer is offered a replacement. In the absence of a replacement item, the cost of the canceled Product is returned by the Seller to the Buyer in a manner negotiated between the Seller and the Buyer separately or in the manner in which the Buyer was paid for the product.
4.5 After placing an order on the Site, the Buyer is provided with information about the estimated delivery date by sending a message to the email address or phone number or by making a phone call to the phone number specified by the Buyer at the time of ordering or by phone.

5. Order delivery
5.1 Methods of delivery of goods and payment methods are listed in the "Delivery and Returns" section.
5.2.1 Orders are delivered across Ukraine by the Nova Poshta delivery service. The estimated cost of delivery for each Order is displayed on the Site at the checkout, but may be changed independently by the Nova Post carrier, based on the weight of the Product, region and delivery method. 5.2.1.1 The Order is delivered within 5 days from the date of order confirmation, if the goods are in stock, unless other terms are specified in the order confirmation. At the time of delivery, the Order is awarded to the Buyer or a third party specified in the Order as the Buyer or Recipient. If the Buyer cannot receive the Order, the Order may be delivered to a person who can provide accurate statements about the Order. At the time of delivery, the delivery service, represented by its representative, has the right to require the presentation of a document certifying the identity of the recipient.
5.2.1.2 The parcel is delivered to the warehouse of the carrier Nova Posta, specified by the buyer. To receive the parcel, it is necessary to present a passport and declaration number. Free storage of the parcel at the Nova Post warehouse is 5 days. After the free storage period expires, the parcel is automatically returned. The Buyer can extend the shelf life of the parcel by contacting the Seller's support service in any convenient way specified in the "Contacts" section of the Seller's website. For each day of storage of the parcel at the Nova Post warehouse beyond the specified period, a penalty is imposed, which is paid by the Buyer.
5.2.1.3 Responsibility for accidental damage or destruction of the Goods passes to the Buyer from the moment of delivery of the Order and the Recipient's signature on the documents confirming the delivery of the Order.
5.2.1.4 The cost of the Nova Post Carrier service - "Receive a refund to a bank card" in case of payment for the goods with the entered payment, the Buyer pays additionally, according to the Carrier's tariffs (20 UAH q 2% of the order value).
5.2.3 In the case of delivery outside Ukraine, the delivery cost is calculated individually and notified to the Buyer by sending an email to the email address and/or phone number.

6. Price and payment of goods 6.1. The price of the goods is indicated in the national currency and includes all taxes provided for by the legislation of Ukraine.
6.2. The price of the goods is indicated on the Site. In the event of an incorrect indication of the price of the ordered goods, the Seller shall notify the Buyer of the confirmation of the Order at the adjusted price or the cancellation of the Order.
6.3. The price of the goods on the Site may be changed unilaterally by the Seller. However, the price of the goods ordered by the Buyer shall not be subject to change.
6.4. Delivery, return and payment of the goods are made by the Buyer in accordance with the terms and conditions specified on the website page in the section https://lipunova.com "delivery and return".
The Seller has the right to provide discounts on goods and establish a bonus program. The types of discounts, bonuses, coupons, the procedure and conditions for their accrual specified on the Site may be changed unilaterally by the Seller.

7. Exchange and return of Goods
7.1. The return of goods takes place in accordance with the return conditions specified on the Site in the section https://lipunova.com "delivery and return".
7.2. The Buyer has the right to refuse the received goods and terminate the Purchase and Sale Agreement in accordance with the Law of Ukraine on Consumer Rights Protection for 14 calendar days.
You can return or exchange the product within the period established by the Ukrainian Consumer Rights Protection Act.
The returned product must be attached to a personally completed return form with the reason for the return. The product is shipped at the buyer's expense.

Return of goods of proper quality: 7.3.1. Return of goods of good quality is possible within 14 calendar days from the moment of its receipt, provided that the goods have not been used, and have also preserved: its appearance of the product, consumer properties, attached labels, tags, labels and tags, as well as the presence of factory packaging. It is not allowed to put inscriptions, addresses and other things on the packaging.
7.3.2. In case of refusal of the Buyer from the Goods in accordance with 7.3.1. The Seller shall return the cost of the Goods to him within 5 (five) days from the moment of receipt of the Goods. The cost of the Goods shall be returned to the person specified in the return form. The refund shall be made by transferring funds to the bank card specified in the return form, based on the cost of the goods at the time of its purchase. Only the cost of the goods shall be returned to the Buyer. The cost of sending the refund shall be paid by the Buyer. If the Buyer sent the package with the return of the Order at the expense of the recipient, the cost of delivery shall be deducted from the amount of the refund.

Return of Goods of improper quality: 7.4.1. A product of poor quality is understood as a product that cannot guarantee that its functional qualities are satisfied. The difference between the design, color or design and the description on the Site is not a sign of inadequate quality of the Product and/or the impossibility of its use for its intended purpose.
7.4.2. After receiving the Order, no claims are accepted regarding external defects of the Goods, their quantity, completeness and type of product. 7.4.3. If the buyer was provided with goods of inadequate quality, the buyer has the right, in accordance with the Law of Ukraine on Consumer Protection, to demand a refund of the money paid.
The Seller is not responsible for defects in the Goods that arise after the transfer of the Goods to the Buyer as a result of the Buyer's violation of the rules for the use or storage of the Goods, actions of third parties or force majeure circumstances.
If the seller's error caused the return, the full cost of the order is returned to the buyer. The Seller of the Online Store also pays for the return shipment of the goods. By mistake from the Seller/Online Store we mean: sending a different model; Sending a different size; mismatch of the color of the model in the photo (for example: instead of a black dress, it turned red). This does not take into account the mismatch of the shade of the same color (bright red - coral), due to the fact that the same image may look different on different monitors.

8. Confidentiality and information protection 8.1 The User/Buyer's personal data is processed in accordance with the Law of Ukraine on Personal Data Protection and the Company's Privacy Policy.
8.2 Personal data is collected solely for the purpose of complying with the requirements governing the legality of accounting and tax accounting, advertising. The period of storage and processing of personal data is three years.
8.3 By providing their personal data during registration on the Site, the User agrees to their processing by the Seller, including for the purpose of promoting the Seller's goods and services.
8.4 The Seller has the right to send informational messages, including advertising messages, to the User/Buyer's e-mail and mobile phone with his/her consent. The User/Buyer has the right to refuse to receive advertising and other information without explaining the reasons for the refusal. Service messages that inform the User/Buyer about the Order and the stages of its processing are sent automatically and cannot be rejected by the User/Buyer.
8.5 The Seller has the right to use Cookies technology. Cookies do not contain confidential information and are not transferred to third parties.
8.6 The Seller is not responsible for information provided by the User/Buyer on the Site in a public form.
8.7 The Seller has the right to record telephone conversations with the Buyer. In this case, the Seller undertakes to: prevent attempts at unauthorized access to information obtained during telephone conversations and/or its transfer to third parties not directly related to the execution of Orders, in accordance with the Law on Ukrainian Information.

9. Validity period of the public offer 9.1. The current public offer comes into force from the moment of acceptance by the User/Buyer and is valid until the moment of withdrawal of acceptance of the public offer.

10. Special conditions The seller has the right to transfer his rights and obligations to third parties.

10.3. The relationship between the User/Buyer and the Seller is subject to Ukrainian legislation.
10.4. In case of questions and claims from the User/Buyer, he/she undertakes to contact the Seller using the contacts posted on the Site. All disputes that arise must be resolved through negotiations. If the parties fail to reach an agreement, the dispute may be referred to a judicial authority in accordance with the current legislation of Ukraine.
